By accessing or using the Digital Junkies website (digitaljunkies.com.au) or engaging our services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and Digital Junkies Pty Ltd (ABN: available on request), a company registered in Queensland, Australia.

Digital Junkies provides digital marketing, web design, AI automation and related services including but not limited to:

•Facebook & Instagram Advertising

•Google Ads Management

•Search Engine Optimisation (SEO)

•Web Design & Development

•AI Marketing Automation & CRM Systems

•LinkedIn Marketing

•Video Production & Marketing

•Digital Marketing Consulting

•AI-powered funnel and lead generation systems

Specific deliverables, timelines and fees are set out in individual service agreements or proposals provided to each client.

Permitted Use: You may use our website for lawful purposes and in accordance with these Terms.

Prohibited Use: You must not:

•Use our website in any way that violates applicable laws or regulations

•Transmit any unsolicited or unauthorised advertising or promotional material

•Attempt to gain unauthorised access to our systems

•Engage in any conduct that restricts or inhibits others' use of the website

•Use bots, scrapers or automated tools to extract data from our site

•Reproduce, duplicate or resell any part of our website without written permission

All content on our website — including text, graphics, logos, images, videos, software and AI-generated content — is owned by or licensed to Digital Junkies and is protected by Australian and international copyright laws.

Client Work: Upon full payment, clients receive a licence to use deliverables created for them. Digital Junkies retains the right to display client work in our portfolio and marketing materials unless otherwise agreed in writing.

Third-Party Content: Our services may incorporate third-party tools, platforms and assets (e.g. stock images, ad platforms). Use of such content is subject to the respective third-party terms.

As a client of Digital Junkies, you agree to:

•Provide accurate, complete and timely information required to deliver services

•Grant us necessary access to ad accounts, websites and platforms

•Respond to requests for approvals or feedback within agreed timeframes

•Ensure all content and materials you provide are lawful and do not infringe third-party rights

•Pay invoices by the due dates specified in your agreement

•Not engage or instruct competing agencies to work on the same campaigns without prior written notice

Delays caused by failure to meet these obligations may affect timelines and will not constitute a breach by Digital Junkies.

Fees: All fees are set out in your service agreement or proposal and are in Australian Dollars (AUD) unless otherwise specified.

Payment Terms: Invoices are due within 7 days unless stated otherwise. Retainer fees are due in advance on the agreed billing date.

Late Payment: Overdue invoices may attract a late payment fee of 1.5% per month. We reserve the right to suspend services for accounts more than 14 days overdue.

Cancellation: Notice periods and cancellation conditions are specified in your individual service agreement. Ad spend paid to platforms (Google, Meta) is non-refundable once campaigns are launched.

GST: All prices are exclusive of GST unless stated. GST will be added where applicable.

Digital marketing results depend on many factors outside our direct control, including platform algorithm changes, market conditions, ad spend levels, client industry and competition.

No Guarantee: While we work diligently to achieve the best possible results, Digital Junkies does not guarantee specific outcomes such as a defined number of leads, sales, rankings or return on ad spend.

Case Studies: Results displayed on our website represent real client outcomes but are not typical. Individual results will vary.

Third-Party Platforms: We are not responsible for changes, outages or policy updates to platforms such as Google, Meta, LinkedIn or any other advertising platform that may affect campaign performance.

To the maximum extent permitted by law:

•Digital Junkies' total liability to you for any claim arising from our services shall not exceed the fees paid by you in the 3 months preceding the claim

•We are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities

•We are not liable for losses arising from third-party platform decisions, algorithm changes or technical failures beyond our control

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law, including guarantees relating to services.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, client data, pricing, campaign data and any information marked as confidential.

This obligation does not apply to information that is publicly available, independently developed or required to be disclosed by law.

Either party may terminate the services agreement in accordance with the notice period specified in your service agreement.

Digital Junkies may immediately suspend or terminate services if:

•Invoices remain unpaid beyond 30 days

•You breach these Terms or your service agreement

•You engage in fraudulent, illegal or abusive conduct

Upon termination, all outstanding fees become immediately due and payable. We will provide reasonable assistance in transitioning accounts back to you.

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Queensland.

We encourage resolving disputes informally first. Please contact us at joe@digitaljunkies.com.au before initiating any formal proceedings.

We reserve the right to update these Terms at any time. We will post the updated version on this page with a revised date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

For significant changes affecting active client agreements, we will provide notice via email.
